ISLAMABA (National Times) Islamabad High Court (IHC) reserved judgment on petition against sealing of PTI central secretariat and CDA operation.<\/p>\n\n\n\n
Justice Saman Rafat Imtiaz of IHC heard the cases.<\/p>\n\n\n\n
Shoaib Shaheen, Umair Baloch and PTI lawyers team appeared in the court on behalf of Umar Ayoub.<\/p>\n\n\n\n
Lawyer Hafiz Arafat appeared on behalf of CDA while state counsel Malik Abdul Rehman represented the district administration.<\/p>\n\n\n\n
During the hearing of the case, Shoaib Shaheen told CDA put notices in their record but no mention is made about the recent notice. CDA committed fraud. If we see, both the notices carry same number. The notices sent by them have not been received by PTI and instead they have sent these notices to Sartaj Ali. CDA have given statement before media that they are going to recover land from Sartaj Ali.<\/p>\n\n\n\n
They told the media that they have not issued notice to PTI. Arshid Dad and Nasim ur Rehman both are members of PTI. Arshid Dad and Nasim ur Rehman purchased commercial plot on July 17m 2020 after agreement.<\/p>\n\n\n\n
On July 29, 2020 , Siraj Ali who is owner of this plot issued letter to CDA for transfer of this plot located in G-8. On July 30, 2020 , this plot of Sartaj Ali was transferred to PTI.<\/p>\n\n\n\n
Shoaib Shaheen told if they have not committed fraud then as to why they have not given references number of all notices. It is must to serve notice before issuance of show cause notice. That notice is where. This plot was transferred to PTI by CDA. This is commercial plot wherein PTI central office exists. Where they had asked for recovery of encroachments , a shelter for parking vehicles was set up there. On May 23, 2024 CDA sealed the office at 11.`15 p,m night all of a sudden.<\/p>\n\n\n\n
Counsel for CDA said he himself had admitted he purchased commercial plot and then he changed the use of plot. Commercial plot was used for party due to which people of that area are being affected.<\/p>\n\n\n\n
The court inquired in what notice it has been said this plot cannot be used for some other purpose.<\/p>\n\n\n\n
Counsel for CDA told the court misuse of commercial plot for establishing political party office is correct. Only our different signatures are wrong. CDA has legal framework and they take notice of such things.<\/p>\n\n\n\n
The court inquired if some one has given plot on rent then notice will go to whom. We have seen many cases where CDA gives notice to some one at one time and to some one else at other time. Why CDA does not issue notice to owner and tenant in such matters so that the matter is settled once .<\/p>\n\n\n\n
Counsel for CDA said first thing is this they had permitted construction to what extent , they extended it equal to what they had been permitted. Constructing small malls is allowed in sub sector. They had violated CDA rules. They should make their own role model. So many their workers come and see They should correct their conduct on the notice of CDA Building control authority. If they have to do on their own will then no one will make commercial use of commercial plot therein. If CDA has issued notice then you should come to CDA and adopt legal way.<\/p>\n\n\n\n
Shoaib Shaheen counsel for PTI said not a single notice in the name of PTI is with him.<\/p>\n\n\n\n
