ISLAMABAD: Supreme Court (SC) has remarked that prima facie government has flouted Lahore High Court decision on allowing Shahbaz Sharif to go abroad. <\/p>\n
The court has summoned all the record of the case from Registrar Lahore High Court (LHC) that when the appeal was filed in high court and the petition was fixed for hearing when. <\/p>\n
The court while issuing notices to Shahbaz Sharif and other respondents adjourned the hearing of the case till June 02.<\/p>\n
A two members bench of SC comprising Justice Ijaz ul Ahsan and Justice Sajjad Ali Shah took up for hearing federation petition filed against Lahore High Court (LHC) order for allowing Shahbaz Sharif to go abroad. <\/p>\n
Justice Sajjad Ali Shah remarked Shahbaz Sharif has withdrawn petition from LHC. How can the federation appeal be heard now. <\/p>\n
Attorney General (AG) took the plea that problem is not of going abroad by any one but it is issue of court\u2019s procedure. We are concerned over the pace at which the court met and the way it was said to implement court\u2019s orders. As soon as the petition was filed by Shahbaz Sharif it was fixed for hearing. High court gave the decision without hearing the respondents. The objection were raised in Lahore High Court on the day Jummatul Wida fell.<\/p>\n
He argued that as per stamp of LHC, the petition was filed on the day the order was given. The LHC stamp is found to have been affixed on Shahbaz Sharif petition on May, 7, 2021. LHC allowed Shahbaz Sharif to go abroad. Emigration authorities stopped Shahbaz Sharif from going abroad. Shahbaz Sharif filed contempt of court plea in the court after he was stopped from going abroad. Later this petition was withdrawn by Shahbaz Sharif. The order for allowing Shahbaz Sharif from going abroad was not withdrawn in the order pertaining to withdrawal of petition by Shahbaz Sharif.
\nThe contempt of court plea by Shahbaz Sharif is pending hearing. LHC remained silent in the matter of contempt of court. Through the petition of contempt of court the decision on allowing to go abroad can be got implemented. <\/p>\n
Justice Ijaz ul Ahsan inquired what step was taken by the government institutions against LHC decision seemed to be flouting the court\u2019s orders prima facie. Now we have to see if LHC orders were flouted or otherwise. Shahbaz Sharif is member of parliament and is opposition leader. We respect all members of assembly. Had Shahbaz Sharif any medical emergency that his case was heard so speedily. How can all the job be done so hurriedly. It is strange how the LHC gave decision without hearing the respondents. There is writing of Chief Justice on most urgent petition. <\/p>\n
The AG took the plea Shahbaz Sharif bail plea on medical ground was rejected. There is no such record that Shahbaz Sharif was facing any medical emergency. LHC did not even hear the federation stance. The LHC gave unilateral order and it was insisted that it should be implemented. Shahbaz Sharif said his name is not in ECL but it was included in black list. Had federation stance been heard then we would have informed that Shahbaz Sharif name is not in black list.
