The petition was submitted by Sheikh Imtiaz Mahmood through his counsel, Advocate Azhar Siddiq. It argues that the Kite Flying Act 2025 was passed in violation of the Constitution. According to the petitioner, who is a member of the Punjab Assembly, a call-attention notice on the issue has already been submitted in the provincial assembly. The petition states that kite flying is ordinarily banned and classified as a non-bailable offense, while the holding of Basant poses risks of loss of life and property to citizens. It further claims that official notifications allowing the manufacturing of kites and kite strings in residential neighborhoods have already been issued, which could endanger public safety.The petitioner informed the court that several countries, including China, have imposed a complete ban on Basant due to its associated dangers. Despite this, enforcing the Kite Flying Act 2025 is said to be against the public interest.
