Court dismisses petition seeking registration of case against former commissioner Rwp

RAWALPINDI (National Times): Additional District and Sessions Judge Rawalpindi Hakim Khan Bakhar has dismissed the petition regarding registration of case against former commissioner Rawalpindi Liaqat Ali Chatha declaring it unjustified.

The court while making report of Asad Khan ASI Civil Lines police station as base maintained that as former commissioner Rawalpindi has said to police that not only one inquiry is pending against him in election commission but also a departmental inquiry is underway against him. He is appearing in both of inquiries in his defence. Therefore, it is clear that legal proceedings against him is must if allegations are proved in the inquiry of election commission and departmental inquiry.

Therefore, there is no justification for registering case separately.

It is pertinent to mention here Arsalan Ahmad and Zaib Fayyaz advocate had filed petition in the court for registration of case against former commissioner Rawalpindi under section 22-A and 22-B of criminal procedure.

The petitioners while making CPO Rawalpindi and SHO civil lines police respondents had taken plea in their petition that former commissioner Rawalpindi Liaqat Ali Chatha during a press conference admitted rigging in recent election through returning officers in all over the division. Press conference was telecast on different TV channels in the country. The petitioner filed application with police for registration of case soon after admission of his crimes by former commissioner Rawalpindi. But police have taken no action so far.

The petitioners requested the court to order police for registration of case against former commissioner Rawalpindi and all co-accused.
