IHC directs sessions court to decide appeal plea in Nikah during iddat case within one month

ISLAMABAD (National Times) Islamabad High Court (IHC) has directed Sessions court to decide the appeal plea regarding Nikah during iddat case within a month and petition regarding suspension of conviction within 10 days.

Khawar Manika opposed the petition.

Justice Miangul Hassan Aurangzeb of IHC ordered additional sessions judge Muhammad Afzal Majoka should decide both the petitions within the period prescribed by court.

The petitions from PTI founder Imran Khan and his wife Bushra Bibi came up for hearing before Justice Miangul Hassan Aurangzeb of IHC Thursday.

During the hearing of case the counsel Suleman Akram Raja said in his arguments ” I have never seen during my career that judge has transferred the case suddenly this way. Sessions judge had heard the case. Now it has been transferred to Additional Sessions Judge (ASJ) . Why it was transferred to ASJ.

Suleman Akram Raja said our first plea is this Sessions Judge Shah Rukh Arjumand be directed to announce reserved judgment or high court should hear the appeal on its own and decide it. The third thing is this appeal be transferred to Sessions judge West. Court should fix time for deciding the appeal by sessions court. Sessions Judge East was hearing it. Now the case be transferred to sessions judge West. Trial was conducted in two days and appeals should also be heard this way.

Raja Rizwan Abbasi counsel for Khawar Manika said that Khawar Manika raised objection over judge and the court rejected his plea. Khawar Manika raised objection again and then sessions judge referred the matter to high court. High court sent these appeal pleas to Additional Sessions judge West on administrator side. The administrator order of this court cannot be challenged directly or indirectly.

The court ordered sessions court to decide appeal plea in Nikah during iddat case within one month and petition regarding suspension of sentence within 10 days.

Justice Miangul Hassan Aurangzeb ordered that additional sessions judge Afzal Majoka should decide both the cases within the period fixed by court.

It is pertinent to mention here that PTI founder had requested the high court to direct the sessions judge to announce reserved judgment or high court should hear the appeal on its own.

Bushra Bibi had requested that the petition regarding suspension of sentence which is pending hearing in sessions court be heard and decided.
