Nikah during iddat case: Court issues notice again on petitions seeking fixation of appeal pleas of Imran, Bushra Bibi for early hearing

ISLAMABAD (National Times) District and Sessions Court Islamabad has issued notices again on the petitions seeking fixation of appeal pleas of Imran Khan and his wife Bushra Bibi for early hearing against conviction in Nikah during iddat case and suspension of their conviction besides adjourning the hearing till June 11.

Additional and District and Session Judge Afzal Majoka remarked ” we had issued notice to the complainant. If he does not want to come then he should not come. The court will hear the case. We cannot fix appeal to the extent of Bushra Bibi. This way shows the mind of the court.

He gave these remarks during the hearing of the case Friday.

The counsels for PTI Usman Riaz Gul and Khalid Yousuf Chaudhry appeared in the court. However no one appeared from the side of complainant Khawar Manika.

Counsel Usman Riaz argued court should fix any one time for hearing. We have to appear in the hearing of 190 million pounds reference in Adiala jail.

Later the court announced interval till 10 a.m till the arrival of counsel for Khawar Manika.

Later judge inquired during the hearing you want early hearing in respect of appeals or want hearing on suspension of the conviction.

Counsel Usman Gul replied court should see the conduct of complainant too.

Judge Afzal Majoka remarked we had issued notice to complainant. If he does not want to come then he should not come. Court will hear the case. We cannot fix appeal to the extent of Bushra Bibi only. This way shows the mind of the court .

He further remarked had the appeal been filed from both Bushra Bibi and PTI founder then court would have been in better position to hear the case.

Counsel Usman Gul said court should give 10 minutes time. We file the petition from the side of Imran Khan too.

The court gave time to the lawyers for filing petition for suspension of the conviction and early hearing of the appeal pleas from the side of PTI founder Imran Khan.

On the resumption of hearing the petition was filed on behalf of Imran Khan for fixing of appeal pleas for early hearing in Nikah case and suspension of conviction.

The court directed to attach affidavit with the petition.

Counsel Niaz Ullah told the court the court can fix the petitions for hearing simultaneously by exercising its powers. However we are filing petition from Imran Khan side despite it.

The court remarked petition from one accused came for early hearing. The court has to balance the things. Petition has been filed on simple paper. Attach the affidavit with the petition. No one has been made party in the petition.

Counsel Niaz Ullah Niazi said its decision was reserved in first court and then it was shifted to second court.

The court while issuing notice again to the respondents on the petitions seeking fixation of case for early hearing of appeals in Nikah during Iddat case and suspension of sentence adjourned the hearing of the case till June 11.
