RAWALPINDI (National Times): Additional District and Sessions judge Rawalpindi Hakam Khan Bakhar has dismissed the petition to summon former commissioner Rawalpindi Liaqat Ali Chatha in person declaring it non maintainable.

The court has adjourned for arguments till May 14 hearing of the petition seeking registration of case.

The petitioners lawyers Arsalan Ahmad and Zaib Fayyaz advocate filed new petition in the court whereby they had requested to summon former commissioner Rawalpindi in person.

They had taken plea in the petition that besides filing power of attorney by him the commissioner also gave this reply that he is appearing before Election Commission (EC) and other institutions in connection with ongoing inquiry. This way if he is appearing before other institutions then he should not feel hesitation in appearing before the court so that he could inform the court about the reasons behind his statement.

In this perspective his appearance in the court in person is essential for decision on the petition seeking registration of case so that ingredients of the justice could be met. Therefore, court should order former commissioner Rawalpindi to appear before it in person on next hearing.

The court dismissed the petition after hearing the arguments of the respondents.

It is pertinent to mention here Arsalan Ahmad and Zaib Fayyaz advocates had filed petition in the court for registration of case against former commissioner Rawalpindi under section 22-A and 22-B of criminal procedure.
